Terms of Service

Agreement

By accessing or using duckteeth.com (the "Site") or joining our early access waitlist, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Site or services. These Terms are between you and DuckTeeth, operated by Chad Kapper, Canton, Ohio ("DuckTeeth," "we," "us").

Early access waitlist

By submitting your email address, you are expressing interest in DuckTeeth's early access program. Joining the waitlist does not guarantee access to the product, create a contractual obligation on our part, or constitute a purchase. We reserve the right to determine eligibility and timing of access at our sole discretion.

SMS communications

By checking the SMS opt-in box and providing your mobile phone number, you expressly consent to receive automated text message notifications from DuckTeeth regarding your waitlist status and early access availability.

Consent: SMS consent is voluntary. Consent is not a condition of any purchase or use of our services. You may opt out at any time.

Message frequency: Message frequency varies. You may receive messages when your waitlist position changes or your early access spot becomes available.

Fees: DuckTeeth does not charge for SMS messages. Standard message and data rates may apply depending on your mobile carrier plan. You are responsible for any charges your carrier may impose.

Opt-out: Reply STOP to any message to unsubscribe. You will receive a single confirmation that you have been unsubscribed. After opting out, you will no longer receive text messages from DuckTeeth unless you opt in again. To re-subscribe, join our waitlist again at duckteeth.com.

Help: Reply HELP to any message for assistance, or contact us at hello@duckteeth.com.

Supported opt-out keywords: STOP, END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, REVOKE, OPTOUT — any of these will immediately unsubscribe you.

Carrier disclaimer: Carriers including AT&T, T-Mobile, and Verizon are not liable for delayed or undelivered messages. DuckTeeth is not responsible for delays or delivery failures caused by carrier networks.

Privacy: Your mobile phone number and SMS opt-in data will not be shared with or sold to third parties. See our Privacy Policy for details.

Intellectual property

All content on this Site, including text, graphics, logos, and software, is the property of DuckTeeth or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

Disclaimer of warranties

The Site and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Your use of the Site is at your own risk.

Limitation of liability

To the fullest extent permitted by law, DuckTeeth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Site or services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed $100.

Governing law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Stark County, Ohio.

Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
